US patent law explicitly allows patent applications to include fictional experiments, also known as “prophetic examples.” Using over 80,000 US biology and chemistry patents, among which 36% contain prophetic examples, we examine the externalities of prophetic examples on both the quantity and quality of peer inventors’ follow-on innovation. We find that compared to patents without prophetic examples, those containing prophetic examples (i.e., “prophetic patents”) attract more follow-on patents by peers. Moreover, the quality of peer innovation following prophetic patents is significantly lower for peer inventors who are unfamiliar with prophetic examples. Additional analyses show that prophetic patents are less likely to be followed on by the focal inventor. Overall, our evidence suggests that fictional experiments in patent disclosures mislead unsophisticated peer inventors into investing more in follow-on innovation that is ultimately abandoned.
